Alternative Dispute Resolution

When There is Another Way to Achieve Success

We are committed to achieving the best possible resolution that the circumstances of a given case permits; however, a court is not always the best forum to achieve that goal. Alternative dispute resolution (ADR) can be an attractive option for parties in conflict to resolve their disputes and often offers companies and individuals greater flexibility and control over the way the dispute is resolved. We can work closely with you to identify the relative merits of pursuing litigation versus employing an ADR strategy, which can, in certain circumstances, lead to faster, more economical, and more amicable results than can be obtained through litigation. Decisions or settlements reached through a given ADR process are final, often narrowing the scope of, or avoiding altogether, a long drawn out and expensive trial and possible appeal.  

The choice of pursuing ADR at the proper time to resolve your dispute may save time, money, and stress, and may help preserve the parties’ privacy from the prying eyes of public court dockets.  

An Effective Approach to Conflict Resolution  

ADR can be a valuable option in all types of domestic, civil and commercial disputes using options including: 

  • Mediation, where an experienced neutral assists parties in negotiating a settlement. 
  • Conciliation, a more robust form of mediation in which the Conciliator, based upon their experience, reviews the relative strengths and weaknesses of each party’s case while assisting the parties in a negotiated settlement. 
  • Arbitration, where one or more experienced neutrals hear the parties evidence and arguments and makes a binding decision on the parties’ dispute.
