Summary judgment for subcontractor upholding a waiver of subrogation

Terrance J. Hamilton obtained summary judgment on behalf of a subcontractor in a ruling that the federal district court described as settling a question of first impression. In interpreting a standard AIA contract between the General Contractor and the Owner, the Court (Lasker, J.) ruled that the standard waiver of subrogation barred the general contractor from pursuing a claim against its subcontractor.
