Casner & Edwards’ Terrance J. Hamilton Prevails on Behalf of Clients in Two Professional Liability Defense Cases



Terrance J. Hamilton, a partner in Casner & Edwards Litigation Group, successfully defended several lawyers and a real estate broker in separate professional liability matters, in court and before administrative agencies.

In April and May 2019, Hamilton received decisions from the Massachusetts Appeals Court in which the court affirmed and upheld the grant of dispositive motions entered in the Superior Court dismissing legal malpractice complaints against his clients. In the first case, Hamilton successfully argued a motion to dismiss in a case where the plaintiff claimed that several of her attorneys had been negligent in their representation of her in an underlying divorce. In the second case, Hamilton successfully argued a motion for summary judgment where the plaintiff alleged that his attorney in an underlying Superior Court jury trial had failed to introduce evidence of his damages. Hamilton also recently represented two attorneys in separate matters before the Office of Bar Counsel as a result of complaints filed with the Board of Bar Overseers alleging that the attorneys had violated various Rules of Professional Conduct. Following an investigation by the Office of Bar Counsel, both matters were closed without any disciplinary action.

Additionally, Hamilton recently represented a real estate broker in a matter brought by the Board of Registration of Real Estate Brokers and Salespersons who had been charged as a result of a consumer complaint  with gross misconduct with respect to a residential real estate transaction and for which the Board sought a six-month suspension of the broker’s license. Following the filing of an answer on behalf of the Respondent to the Board's Order to Show Cause and at a prehearing conference, Hamilton and his client were able to adduce evidence refuting the allegations of the complaint and establishing that any failure to timely return the escrow deposit was the result of a dispute between the buyer and the sellers and not the fault of the real estate broker. The Board dismissed the charges.
 
Hamilton specializes in professional and legal malpractice litigation, personal injury matters and commercial litigation. He has substantial trial court experience in the state and federal courts and extensive appellate experience (over 40 reported decisions) before the Massachusetts Supreme Judicial Court, the Massachusetts Appeals Court, and the United States Court of Appeals for the First Circuit.
