Casner & Edwards LLP announces that Christopher Maffucci, a partner in the firm’s Litigation Practice, obtained a settlement in excess of $1 million for a manufacturer that had a defective solar power installation on the factory’s roof.
The client contracted with a solar power company to install, own and operate a solar-powered electricity system on the client’s roof. Immediately upon completion of the installation, storm water from the roof began to penetrate the interior of the building. Several breaches on the building’s roof that occurred during the installation were located and repaired, but months after the installation, leaks continued to appear. New roof leaks continued throughout the year following completion of the solar power system, at which point the solar power company claimed that the age of the roof was responsible for the leaks. When the solar power company refused to perform permanent repairs, the client sued. The matter settled at the conclusion of discovery with the defendants paying the client over $1 million plus the installation of a new roof.
Maffucci maintains a general civil litigation practice representing businesses, non-profit entities and professionals involved in contract disputes, employment issues, regulatory matters and property taxation. His practice also includes real estate, land use and construction litigation, representing real estate brokers, developers and contractors when disputes arise out of transactions, property development or construction contracts. He has handled trials and appeals in state and federal courts in Massachusetts, New Jersey and Pennsylvania, and has extensive experience in arbitration and mediation.
