Casner & Edwards Attorney Sharon C. Lincoln Speaks at the Virtual 2021 NAAG/NASCO Annual Charities Conference
Casner & Edwards LLP partner Sharon C. Lincoln spoke at the virtual 2021 NAAG/NASCO Annual Charities Conference, October 13th. Her panel, “A Brave New World of Working Together: State Law Questions Surrounding Arrangements Between Charities and NonCharities,” explored some of the real and hypothetical questions involved when charities interact with non-charities.
Lincoln and fellow panelists discussed federal tax issues and state law considerations, including those related to the duty of loyalty to charitable purposes and honoring donor intent; the duty of care; related party transactions; investment standards such as UPMIFA provisions; registration and reporting requirements; charitable solicitation and co-venture rules, just for starters.
Lincoln advises nonprofit entities on the wide range of issues related to their tax-exempt status, including formation, funding, governance (including conflicts of interest), executive compensation, regulatory compliance, corporate restructuring and affiliations, international grant making, lobbying, unrelated business income, and mergers and acquisitions. In addition, she assists clients in matters directly involving the Internal Revenue Service, the Massachusetts Attorney General’s Office, and the Massachusetts Department of Revenue, including audits, appeals and ruling requests. Lincoln is a member of the Boston Bar Association Tax-Exempt Organization Steering Committee, the TEGE Exempt Organizations Council Board of Directors, and the ABA Tax Section.
