Anita S. Lichtblau, a partner in Casner & Edwards’ Nonprofit Organizations Group, presented “Nonprofit Executive Compensation from The Legal Perspective” at the annual nonprofit conference of the Massachusetts Society of CPAs, January 24, 2017 from 1:20 p.m. – 2:50 p.m. at the Sheraton Hotel in Framingham, MA.
Lichtblau’s presentation addressed the fiduciary responsibilities that nonprofit directors and officers must follow under state law and the requirements for exempt organizations under federal law regarding setting compensation for executives at reasonable levels. Lichtblau discussed how the Massachusetts Attorney General, courts, the IRS, and other government agencies apply these principles and rules to determine what is “reasonable” compensation, what steps a nonprofit must follow to secure a presumption that the compensation is reasonable, and how to spot the compensation red flags that may cause financial and regulatory troubles down the road.
As a member of Casner & Edwards’ Nonprofit Practice Group, Lichtblau advises nonprofit organizations on wide variety of legal issues, including formation of organizations and application for tax-exempt status, maintenance of tax-exempt status, governance, lobbying and political activity, creation of corporate policies, employment matters, and government and private grants and contracts. Lichtblau is co-chair of the Education Committee of the Tax-Exempt Organization Section of the BBA and a member of the Section’s Chapter 180 Working Group. She is also a member of the BBA Tax-Exempt Organization Steering Committee.
