Casner & Edwards Adds Business Litigator Michael J. Fencer to Its Bankruptcy & Restructuring Group

Boston law firm Casner & Edwards, LLP announces that attorney Michael J. Fencer has joined the firm’s Bankruptcy & Restructuring Group as a partner. His addition also establishes a dedicated Construction Law & Litigation practice for the firm.

Fencer focuses his practice on commercial insolvency and reorganization, bankruptcy litigation, construction law and complex construction litigation, commercial litigation, and administrative law.  He represents corporate and other business debtors and debtors-in-possession, creditors, official committees, trustees, asset buyers, and other parties in commercial bankruptcy proceedings in United States bankruptcy courts across numerous districts, including Massachusetts, New York, Delaware, Florida, Virginia, and Texas.

Additionally, Fencer has prosecuted and defended claims on behalf of clients in state and federal trial and appellate courts involving fraudulent and preferential transfers, director and officer liability and insurance coverage claims, construction defects, construction claims for lost productivity and other claims for extra-contractual compensation, and the enforcement of construction liens and bonds. Fencer also has advised and represented various parties to distressed merger and acquisition transactions, as well as asset and stock transactions. He frequently represents licensed professionals and tradesmen in administrative enforcement and disciplinary proceedings before various state licensing boards and commissions.

Prior to joining Casner & Edwards, Fencer was a partner in, and practice group leader of Jager Smith P.C.’s Bankruptcy and Restructuring and Litigation Groups. Before that, he served as a law clerk to the Honorable Joel B. Rosenthal of the United States Bankruptcy Court for the District of Massachusetts.  Fencer is also licensed by the Commonwealth of Massachusetts as a Master and a Journeyman Electrician.

John T. Morrier, Casner & Edwards’ Managing Partner, said, “While some peer firms are maintaining or reducing their bankruptcy practice ranks, we see an opportunity to add talented attorneys to our Bankruptcy & Restructuring Group to meet increasing demand for middle market and smaller-scale insolvency matters.”

“Michael is an experienced and respected Boston attorney who brings to bear significant experience in commercial bankruptcy, construction and administrative law,” continued Morrier. “His broad legal skills will also help us form a Construction Law & Litigation Group to coalesce the type of construction-related work that many of our attorneys are handling.”

Fencer commented, “Casner & Edwards offers an ideal platform for me to grow my practice. The firm’s focus on steady growth and attorney collaboration are compelling and will benefit my clients in both the bankruptcy and construction areas.”
