Stephen M. Perry is a business litigator practicing primarily in Casner & Edwards’ Litigation and Employment Law areas. He serves as Chairman of the firm’s Management Committee. Mr. Perry handles a broad range of matters, including employment cases and sophisticated business and commercial disputes. Since 2005 he has been recognized annually as a Massachusetts Super Lawyer® by Boston Magazine, an honor awarded to only five percent of the bar.
Mr. Perry has handled in state and federal courts a wide range of business and commercial disputes, including contract disputes, business torts, and claims for breach of fiduciary duty involving owners or directors of closely held corporations. He has considerable experience in cases involving the contested valuation of business or real estate interests.
In the employment law area, Mr. Perry counsels corporations and executives regarding such matters as employee terminations, sexual harassment investigations, the Family and Medical Leave Act, covenants not to compete, and discrimination claims. Mr. Perry has successfully defended employment claims in state and federal courts and before the Massachusetts Commission Against Discrimination and the Equal Employment Opportunity Commission. He has also recovered substantial judgments and settlements on behalf of executives and other individuals asserting employment-based claims against their employers.
Mr. Perry has achieved noted successes in business cases arising under ERISA, including winning and upholding on appeal to the United States Court of Appeals for the First Circuit a $9.5 million class action judgment, and successfully representing pension plan participants in Ohio in a $14 million claim, including through two interlocutory appeals to the Sixth Circuit Court of Appeals.
In addition to his litigation practice, Mr. Perry serves as general outside counsel to several business. He is also a certified mediator and available to serve as a neutral mediator in employment, business or personal injury cases upon request.
After obtaining a bachelor’s degree from the Massachusetts Institute of Technology, Mr. Perry received his J.D., magna cum laude, from Harvard Law School, where he was an editor of the Harvard Law Review. He subsequently served as law clerk to the late Bailey Aldrich, of the United States Court of Appeals for the First Circuit. Mr. Perry is a member of the Massachusetts and Boston Bar Associations. He served for twelve years on the Natick Zoning Board of Appeals.
