On December 16, 2010, the Supreme Judicial Court held that for purposes of the Fund’s $299,999 statutory cap, a loss of consortium claim is a separate claim under the statute and that the Fund is potentially liable up to the statutory cap for each of the claims asserted by the family members.click link to read more:
