Donna M. Brewer served as co-counsel with the Atlanta firm of Sutherland, Asbill & Brennan in the defense of a client sued by a private equity firm for alleged breach of contract. The plaintiff alleged that the client failed to close on proposed acquisition financing and instead completed the acquisition through seller financing. There were highly contested issues concerning the meaning of the contract terms and whether the client’s conduct caused any loss to the plaintiff. After an 11-day trial in federal court, a jury returned a verdict in favor of our client.

Congratulations to Marc E. Fitzgerald, a Partner, in the Probate & Family Law Group, who was recently re-appointed to the Massachusetts Bar Association Family Law Section Council for 2009 - 2010. Mr. Fitzgerald was again selected and recommended by his peers for this post due to his advocacy and reputation within the community. Mr. Fitzgerald will again join a sixteen member panel that is charged with analyzing and preparing legislation, developing educational and professional development programs, producing articles and formulating and recommending policy and legislative positions to the House of Delegates.
- Robert E. Cowden III and Richard C. Allen, of the firm's Nonprofit Organizations Law Practice, are serving, by invitation, on the Advisory Committee of the Massachusetts Attorney General's Nonprofit Organizations/Public Charities Division.
